A man is suing for discrimination because MARTA, the Atlanta metro bus and train system, is requiring him to pay for and undergo a sleep study as part of his employment approval process. He is a large black man with a size 17 neck and a BMI of 38. He is claiming that he is that large because he used to play football, but that he is in shape, runs every day, and can still bench press 400 lbs. He claims that he is being discriminated against because of his build.

Apparently, he actually paid to have a sleep study done with his own money, but the results of the PSG were "inconclusive." (No details given about those results in the news report.) MARTA apparently wants him to get retested--again on his own dime--before they can offer him the job.
