Re: [MTC Global] [Weekend Big Debate] What to do when your boss asks you to do something illegal ?

A few cases are presented below. You may draw your own conclusion.

  1. After taking my first job after graduation, as Deputy Engineering in PWD, I was told by my Executive Engineer to give him 40 kg of rice. I enquired with my colleague who  advised me get 60 kg rice from the vendor, you keep 20 kg rest to EE. The next day I resigned.
  2. Then I took up the job of Asst. Lecturer in Govt. Polytechnic an within two months sent for inspection of furniture, I rejected the entire lot as the furniture was not facricated as per the drawing given to me. Principal tried to convince me that such variation can be allowed. I refused to yield. Principal changed the inspector, got the bills passed. Principal got some furniture free. But the Principal always loved me.
  3. When I was the Principal, one non-SC candidate entered through University BC Committee as Lecturer in SC category, satisfactorily completed his probation, he got B E ME admission as SC candidate. After 3 years I came to the conclusions that he was not an SC candidate, informed the Govt. Institute where he was doing his ME, his admission was cancelled. VC, BC Cell and a few Trust personnel started pressing me not take any action. Finally, I was called by VC who threatened me for dire consequences. I plainly told him i am for the Constitution, he has played with three lives at B E, ME and Lecturer cadre as he did not belong to SC category, I am therefore not for my Institute, University or VC. I returned to my Institute and without loosing a single moment issued him termination orders being non-SC candidate (against SC category) with three months notice period pay. Nothing happened then.
  4. One of my friends was working as a Sr. Engineer in KOEL, Pune. One day his boss asked to overstay after working hours as the boss wanted to discuss something with him. He waited and waited but boss did not call him, He came to know that the boss left the Office long back. Next day the boss realized the thing and called my friend. My friend simply told him Sir, it  was his fault he failed to make query immediately after working hours and waited for his call. The matter was closed. Etc., etc.
To come across such situations is a part of life. One will have to take decision as per one's potential. There is nothing like  formula for handling such situations.Gain or loss is a part of game. Take it in a relaxed mood, listen to your inner voice and take a decision. Loss or gain is a just tide in ocean!

Dear All,

I once faced an unethical situation as a head of marketing in a private sector company. We were to launch a new  table fan with a unique design in Mumbai. We were ready with all the marketing activities and were waiting for the new fan which was produced in our Baroda factory. There was a delay in the manufacture, but finally when the product arrived, it was found to be defective, as its oscillation mechanism  was not functioning. I stopped selling the fan and requested for an immediate meeting to sort out the issue. In the meeting, I insisted that we should not sell a defective product and should  first correct the defect in the product. The managing director did not agree and said " we would take steps to correct the defects in the new product, but in the meantime I order you to sell the new fan. " I got up from my seat and said " I don't agree with your decision of selling a defective product. I am resigning right now " and walked out of the room !

I was without a job for about six months, but it gave me a tremendous strength to face  unethical situations in my industrial career spanning 30 years, as that was my first job after completing my post-graduate diploma in management from IIMA.

Dr. Singh Sb. has rightly and clearly portrayed the realistic picture in the industry. One who is clear and firm about his principles need not be in a dilemma; he / she should handle things tactfully and face the situations patiently and deftly. Prof. Goel Sb has given a good example in this regard when confronted with your boss in such a situation, though it works less in private sector!

The real concern is, that such situations are becoming quite widespread in academic circles too!

Dear all,

This is absolutely no dilemma. It is very clear what to do in such situation.

Normally, bosses will not ask openly to do something illegal or unethical for personal benefits. However, if such situation arises, the personality of the subordinate will determine the degree of dilemma. A weaker personality will succumb to the pressure and crib, while as strong personality will have no  difficulty to  say, "No sir, you can not expect me to do that." He will also be ready  to face the consequences - confrontation, harassment, victimisation, etc.  and can consciously  decide to fight or flight.

However, in many situations in India, you have to do certain things, which normally are illegal and unethical but very commonly done by people  in organisational interest, whether you like it is not. For example, making periodic payments of cash, gifts , etc. to regulatory authorities  of government and bribing authorities in cases of procedural lapses, accidents, nonconformities, etc. are very common duties of certain functionaries in commercial / industrial organisations.

However, one can consciously choose the profession and assignment, where you can avoid such functions, if you so  want, but then should also be ready to accept its consequences as well, like may be  slower  growth of career  and lower pay and perks in life.

In my over three decade long career in academic and  Industry - PSU, MNC and Private, have never faced any such dilemma,  for I was very clear from the beginning , as to what I should do in such circumstances, if ever faced.

When your boss asks you to do something illegal or unethical, you face one of the most challenging dilemmas in your career. "There are potential negative consequences for speaking up, as well as for complying,". "It can feel like a lose-lose."

How to handle such situations?
