The MRC or Professor Kamto explains in relation to the criminalization
of the non-payment of rents relating to civil commercial
landlord/tenant contractual commercial obligations: "S'agissant de la
filouterie de loyer, cette infraction fut introduite sur proposition,
face aux difficultés quasi insurmontables auxquelles
était confrontée notamment la Société Immobilière du Cameroun (SIC)
pour recouvrer des loyers impayés parfois depuis plus d'une décennie,
alors qu'elle doit réinvestir dans la construction pour contribuer à
la résorption de l'immense déficit de logement dans le pays.
L'objectif ultime était donc de susciter et d'encourager
l'investissement dans l'habitat locatif afin de densifier l'offre de
logements, et donc de faire baisser les coûts des loyers parfois
prohibitifs".
This revelation underscores the influence peddled by special interests
in the legal engineering of the draft criminal code. The alleged crime
therefore did not offend against a general societal value but the
business interest of a powerful special interest real estate
corporation. The allegation if true is itself criminal and should be
investigated and prosecuted. Although intended to serve the rent
recovery effort of SIC, this provision re-enforces the power of the
police state. It invites the police and law enforcement agents into
the home and family life of potential violators or rents defaulters
thus violating article 17 of the International Covenant of Civil and
Political Rights, which protests the rights to family life along with
other provisions protecting the privacy of individuals. It
discriminatorily puts millions of the majority poor at the risk of
criminal prosecution for defaulting the payment of rents in a polity
where the provision of housing and basic means of subsistence is not
guaranteed to a majority of the people.
The influence of special interest in this process is a slur on the
image of Cameroun and sends chills down the spin of millions relating
to the supposed independence of the judiciary, a mantra trumpeted by
the government but rejected by the African Commission on Human and
Peoples' Rights ( Ngwan Gumne and others v Cameroun) SCNC/SCAPO case.
