Re: [MTC Global] Provide higher education to poor girls from CSR funds

Rules and Regulations look good on paper and naturally any ruling government in power would surely want to showcase what their plans and focus for Social Responsibilities would they be unfurling in times ahead. Big Corporate Houses I repeat use the CSR tool as Tax saving method. Yes, they may be investing it in Primary Education under either their own banner or a sister concern banner. Recently on ABP News one prominent and successful business magnate from Gujarat was given a 200 Crore Tax Waiver by P.M. So the strict CSR Acts and Rules may be on place in the paper but the adherance is what I am talking about and being aware of media reports it just makes all the claims hollow. I do agree with some of my esteemed colleagues who have cited how people from their known circles have contributed and I myself have knowledge of some NGO's who are operating with No Help from either Government or Corporate and are funding their activities from earnings of their family members as CSR for them is a way of life.

CSR funds cannot be misused and they are not meant for tax savings. Anybody making that statement has not studied the Act and rules of CSR. This is perhaps only law where loopholes are plugged immediately on any such finding and there is a strict audit on CSR liability of company covered under the law and utilization of CSR funds.

CSR is now just relegated to a Tax Savings measure which many corporate have found a good source of saving income by investing a small percentage of the same in some or the other cause.

Yesterday Minister of State for Home - Mr. Kiren Rijiju gave out statistics that Foreign Aid ban on 10,000 NGO's in last year and over 14,000 Outfits were barred from receiving overseas funds since 2012. The proud statistics that the government has rolled out signals the death of one more sector - NGO's. One may argue that the NGO's were being funded for subversive activities. Quite possible that some black sheeps may be there in the crowd but to tar every NGO with the same brush of taint is something which isn't wise. Having worked in NGO sector briefly before my switch to Academics, I know that there are NGO's who do a lot of yeoman's service and there are foreign funding agencies who appreciate their work and give them help and financial support but alas, with government restrictions many NGO's are now in their last lap of survival. Come to think of it the globally present NGO - Bill & Melinda Gates too was axed by this Government.

Government's mere sloganeerings tom-toming new initiatives and allocations of funds are mere eyewash and a political upmanship and vote bank politics. In reality even the promised funds hardly ever reach the beneficiary.

However the bright side is that regardless of non availability of foreign donations, irrespective of blockades and hurdles coming their way, there are people who are dedicated to serving for a cause even if it means spending their hard earned money and they are behind the scene stage actors who don't care about name, fame or recognition but continue to do the good work.

I support CSR in our country. But when a term in itself is vague is not waste in supporting that type of term.
My doubts are: Please correct me if I am wrong:

1. CSR has not been defined properly in our country until now. So contributing for that purpose how far is it correct?
2. If I do CSR in my state can it be called as CSR.
3. What type of activities can be called as CSR is there any list. As a lawyer I know pretty well how it is being distorted in the market now a days.
4. Once a company becomes eligible for CSR and again if its profits comes down, does it mean that they need not contribute.
5. How you will audit? Are we having enough accounting mechanisms for social audit?
6. Also when we are promoting CSR are we accepting the defeat of our so called elected democratical governments as it is the primarily responsibility of the government to take care of the society.


Not only Bholanath dutta sir any body could you please contribute for my doubts.

​DEHRADUN: Uttarakhand governor KK Paul on Monday directed the state government to ensure that the girls, who are from remote hill areas and belong to unprivileged families, are given subsidized higher education from the Corporate Social Responsibility (CSR) funds of private universities in the state.

"So many private universities are coming up in the state and they should give back to the society. If these girls get higher education from the CSR funds, it will change their lives. I am sure this initiative will bring positive change for girl students in the state. Education certainly empowers a person and we intend to empower the girls," the governor said.
