The questions raised are of extreme importance but before talking about a mediator we must first agree on a few things. What are we fighting for or complaining about. If it is the mass killings and other atrocities, that will fall squarely in the domain of Human Rights. Human Right violations can be resolved both locally and by International Jurisdictions such as the UN and African Union Human Right Committees. If we are complaining about the bad administration such as the deployment of Teachers and Judges from the Francophone areas to serve in English speaking regions, that will look like a purely domestic issue. The government can handle that. That is what they have been pretending to do by creating ad hoc committees and using Presidential Decrees and other administrative fiats to attempt a solution.
But if we are talking about our independence, we must also agree from who we are asking for the independence. In other words in this independence discussions, who are the parties to sit on the discussion table?
My position and personal understanding is that the issue at stake is independence. I think our independence problem can be summarized in this short form:
SOUTHERN CAMEROON INDEPENDENCE WAS WRONGLY STARTED BY THE UN AND NOT EVEN ALLOWED TO RUN THROUGH THE CHECKERED PATH PUT DOWN BY THE VERY UN that purported to start the process. Why was it wrongly started, one might ask. The answer is simple. The independence by joining one country or the other was just wrong and illegal. It was wrong because the elected representatives of the people asked for a third alternative (that of full independence) but it was turned down. Why was it illegal? It was illegal because independence by joining was contrary to the letter and spirit of Article 76 (b) of the UN Charter. It was further illegal because the Republic of Cameroon with who Southern Cameroon was supposed to join on October 1st 1961 voted against UNGA Resolution 1608 (XV) of 21st April 1961. Once one of the partners (Republic of Cameroon) voted No to the resolution, there was no more legal basis for continuing the process. The UN does not have any authority to force a member state like the Republic of Cameroon was in April 1961 to enter into any union against its wishes. To further compound the issue, the very UN that was attempting to force the parties into a union did not make sure that the process leading up to the alleged joining ran its cause. Why and how did this happen? The answer is that section 5 of UNGA 1608 was not even implemented. That section if applied would have laid out the terms of the union.That did not happen and has never happened.
If the above short summary is correct then our plight is to be addressed in essence by the UN. In this case the principal parties shall be Southern Cameroon, the UK as administering authority and the UN. The Republic of Cameroon can come in to prove the contrary to what we are arguing but in essence they are not a principal party. In this scenario, the African Union looks like out of the business completely. It is true that the African Union does not have effective enforcement mechanisms. It is also true that the African Union does not have the powers to grant any territory independence. The African Union has never owned colonies, protectorates or trust territories. The UN had jurisdiction over Southern Cameroon as a UN Trust Territory. The African Union can take other actions or make recommendations to the UN as a strong regional organization. But why do we have to go that route to end at the very United Nations? Why not face the bull by the horns straight away?

Don't we have sufficient evidence? It is not like you people will be introducing a new matter to the AU Rep in NY York. He/she is obviously aware of it already. Children have lost or at the verge of loosing a whole academic year now per the UNESCO regional office in Yaounde. That being the only trump card we have and are using does not mean we like these children to loose another year. Maitre Bobga is there. What can they be waiting for?

the AU has very little enforcement mechanism and generally depends on the good faith of the member states to do things although it has sent troops in some troubled areas in the past but even in such situations, it normally depends on donor nations to pay the salaries, emoluments, allowances etc. of the troops.
In terms of a dispute, one party can propose a third party mediator or both parties can jointly appoint a mediator and in some jurisdictions, the court can appoint a mediator, If Southern Cameroons officially invites the AU to mediate, La Republique du Cameroun can refuse to take part in such mediation or talks and there is little that can be done. Ethiopia had issues with Eretria and Qatar offered to mediate but Ethiopia snubbed Qatar and said "Qatar is trying to punch above its weight by offering to negotiate on an Ethiopian issue" . Qatar felt highly slighted and came back and deported almost all Ethiopians working in Qatar (most do not understand English well hence the do low level jobs such as house maids etc.)
La Republique du Cameroun will want to say it is its domestic issue and no other nation should interfere whilst Southern Cameroons believes the issue is an international one and AU and UN should come in indirectly or directly. AU has some other powers that it can use and La Republique is scared of such powers and cannot ignore AU totally e.g. if AU should give say observer status to Southern Cameroons, that will be the beginning of the end.
Another issue is that these strikes, tortures, murders, disappearances etc. might have an impact in another way. It might tailor the views of ACHPR Commissioners reviewing communication 266 that Southern Cameroons brought against La Republique du Cameroun and the government might also be worried about this. Remember that Communication 266 failed because the ACHPR invoked the Katanga Principle and concluded that there is no gross violation of human rights in Cameroon to the extent to warrant a separation of the two Cameroonians and wanted the Complainants to instead form political parties and try to resolve the issues they are raising but if the videos, audios and pictures that were circulating daily as was the case in the recent past continued, perhaps the Katanga Principle threshold could have been reached and the review of Communication 266 might have come out with a different result.
Let me not make this too long and perhaps boring.

Good morning. Kindly allow me ask a question that has been bothering me for some time now. It has been published that the Chairperson of the AU has indicated the willingness of the AU to mediate on the problem between the Southern Cameroons and The Republic of Cameroon. But in a situation as this, how does the AU come into the negotiation process of settling the dispute? Who invites them in? The AU will be trying to play the part of the honest broker - and honesty is something the Cameroon government does not want given the tons of evidence the Southern Cameroons has against it - i.e the evidence which would include the historical events since 1961( i.e.if we have to limit the problem only from the passing of the Resolution 1608 by the UN that the Southern Cameroons should attain independence by joining either The Republic of Nigeria or The Republic of Cameroon, to the point where we are today demanding either a federation or outright independence as raised by the Teachers and Lawyers). So who invites the AU into the talks in the first place? Most importantly if the Cameroon government refuses to initiate further talks as I suspect they will want to do given the fact that Mr Biya has signed a series of decrees which seems to give a finality to talks since the government claims the decree is meant to slowly solve the concerns oand all the issues raised by the Lawyers and Teachers unions. Infact we all know that the decree has completely ignored the genesis and evolution of the problem which stands now at Federalism or independence. So who is going to jump-start the talks now since we know that these decrees practically mean nothing to us so far as the issues raised are concerned? And again how will the AU get into the talks? The CPDM would not want them by any stretch of the imagination. Does the AU have any powers to initiate and then force itself into the talks as a mediator? If no, then we will never get a solution. That is the way I see it. What do you think? Is there a mechanism based on the AU's recognition, and involvement - involvement even if only by recognition of the problem) that we can evoke as a people to start this real talks with the Republic of Cameroon? You are the international law experts and must have a good knowledge on conflict resolution - from the beginnings to the end. I am asking these questions not because what we should know now is"Where do we go from here?" The general strike has been very successful and if we were dealing with a more rational opponent, the problem would have been solved long ago.

In Yaoundé he has been located with many others that had disappeared from north and southwest at the gendarmerie by the lake near education. In his own cell room alone is 21 of them packed full he said.
