How will AICTE approve or reject when its in dilemma of what is right or wrong? Every now and then we can see an order passed on an issue and the next day of in few days after, the same been summarily rejected or opposed and then AICTE coming back to claim that the previous decision needs reconsideration so, things will go on as it is till further order is passed. For anything and everything there should be some timeline in which orders should be in execution and cant be changed till the same passed. Where you have freedom to say something and change the same thing within no time, where and when can get standardization of the systems and procedures. If this is the case, where is the possibility to approve or reject the institutions affiliated to such indecisive bodies?

Sir, There is no reason to delay the decision. The AICTE should either reject the
approval or issue the approval. A likely scenario is that these Institutions have been
set up by politicians from both sides of the divide. There could be non compliance or
partial compliance concerning approval requirements. The classical argument that lacs of
students have to undergo torture is an old one to put the pressure on the AICTE. Many
such decisions require approvals/nods from the political bosses. Perhaps, AICTE is
awaiting for clearance from the MHRD. In either case, there is no reason why AICTE cannot
inform their decision within the stipulated time frame.

I think, the concerned Institutions must await the decision from AICTE under SC
injunctions.

 Courtesy the continuing, increasing and rampant corruption in AICTE - the mediocre and
sub-standard management and technical institutions are being given the approvals and
approval renewals by AICTE. As per one of the latest surveys, the percentage of such
institutions has now increased to 93% as compared to around 80% mentioned by Ishwar Dayal
Committee report in the year 2000. Those institutions with merit but not willing to
compromise are harassed, throttled, thwarted, undermined and victimised by AICTE in
myriad ways like delaying the approval/renewal, asking the concerned state government to
lodge FIR, fabricating frivolous complaints to take fraudulent action and even some
bizarre ones like denying the approval on concocted excuse like campus being located in
the rural area and not in the city. This they do even for those institutions which have
been commended by the experts as the role model institutions, totally disregarding the
fact that in the process AICTE mandarins are working against the legislative mandate of
the AICTE Act by which AICTE itself came into existence and also against the national
interest. 
 
One of the examples of this rent-seeking character of AICTE is its system of the yearly
approval - where the institutions need to get the renewal of the approval every year from
AICTE. It is beyond any logic and rationale as to how any institution which was found
suitable for being given approval in a particular year and is not suitable in another
year.

New Delhi: The Supreme Court on Tuesday came down heavily on the All India Council for
Technical Education (AICTE) for delay in granting approval to technical institutes which
caused delay in academic sessions and warned it of dire consequences if it failed to
comply with the timeline fixed by the court.

The council found itself at the receiving end for not taking timely decision on approval
of 621 technical institutes in Uttar Pradesh. As per the timeline fixed by the apex
court, AICTE was supposed to take a decision by April 10 but it delayed the process and
passed the order of approval only on May 7.

Taking strong exception to the council not complying with its order and delaying
approvals, a bench of Justices P C Ghose and Amitava Roy directed AICTE to file response
within a week why it should not be held up for contempt of court.

"Don't take us for granted. We will be extremely ruthless with you. We will call your
officers and start contempt proceedings. Don't play hide and seek with us. We are not
sitting here for nothing," the bench said and directed the counsel appearing for AICTE to
explain why there was a month's delay in granting approvals .

The apex court had in 2012 fixed a schedule for granting approval and affiliation to
technical education institutions to ensure that there was no delay in academic session.
It had also fixed a schedule for conducting entrance examinations and admission process.
It had ordered that admission process must be completed by July 31 and academic session
must begin from August 1.

Despite the apex court's order for strict adherence to the schedule for grant of approval
as well as for admissions, the direction is not being implemented in letter and spirit,
with authorities failing to adhere to the timeline and the colleges having to approach
the SC every year against AICTE for not taking decision on time.

Slamming it for working "casually" in granting approval to colleges, the court said there
was a serious lapse on the part of AICTE and it may be directed to pay cost for playing
with the careers of thousands of students in 621 institutes in UP.

"You change our order every year. How can  AICTE tinker with the timeline fixed by us? We
are the final authority on this issue. We cannot tolerate defiance of our order and we
will take action against officers of AICTE for violating our orders. Let the officers
learn a lesson," the bench said.
