Fw: THE BANJUL RULING: THE WAY FORWARD BY AYAH Paul ABINE

RE: THE BANJUL RULING: THE WAY FORWARD

 AYAH PAUL ABINE
My problem with the ruling is that the Southern Cameroons drags LRC to the ACHPR. The Commission turns around and recommends dialogue between the two. Who would supervise such talks? What would equally be the basis of such talks? Where would the talks take place? The recommendation was totally vague. The way forward as Hon Ayah has put across here is a sound proposal. However, there is the Southern Cameroons Restoration Council which was put up on August 12 right inside the Southern Cameroons.
The SCRC has been working hard. My proposal is that Hon. Ayah joins that Council. The Council would then come up with decision as it has been issuing some statements and decisions since its formation. All Southern Cameroonians would then keep up with the decisions of the Council. If they settle on the formation of a government, then so be it. That government would not be for any talks with LRC. Any talks with LRC would be for the sharing of assets, period. After the government of the Southern Cameroons is established, it would be time for us to take care of our country. Seeking membership of major international bodies should now help legitimize our status. Quite frankly LRC is not competent enough to handle our case. It is going to be the UN. This would only happen after we are in control of our affairs in Southern Cameroons.
Today, Charles Taylor of Liberia is in prison with the ruling of the International Criminal Court the ICC. The President and Vice President of Kenya are both facing the ICC for crimes against humanity. What LRC has done to us for the past 52 years puts that country qualified to face ICC on charges of crimes against humanity. We should all rise up like one man to support the actions of the SCRC.

THE BANJUL RULING: THE WAY FORWARD
BY
AYAH Paul ABINE

Few jurists would contend that the recognition of persons of Southern Cameroons' origin as "a people" by the African Commission for Human and People's Rights was a momentous act constitutive of statehood. The appeal for dialogue between Yaounde and the
Southern Cameroonians however has been stalled by the very Yaounde that did apply for six extra months some three years ago to get into dialogue in compliance.

Struck by the disregard for the international community by the very authorities that ever preach peace at every opportunity, Ayah went out in search of answers. He gathered from some high-ranking person in authority in Yaounde that Yaounde is banking on the fact that there are no Southern Cameroonian leaders to dialogue with. That Yaounde does argue additionally that the court did recommend that Southern Cameroon's pro-self-determination groups should be registered as political parties.

While the first argument seems plausible, the second to my mind is idle. It is a matter of law in Cameroun that no party can be registered that does not stand for "one and indivisible" Cameroun. Nor should anyone reasonably expect anyone to arm the opponent to fight them.

The way forward for Southern Cameroons then is for those pro-self-determination groups to revive the Southern Cameroons' government by appointing ministers. Upon doing that, Yaounde would be presented with a team to dialogue with. Yaounde will thus be divested of their pretext of absence of leaders for dialogue. This after all will only be consistent with the SCNC non-violent slogan of "the force of argument".

Yaounde cannot remain intransigent to such peaceful approach because the international community is wholly conscious that making peace far outweighs keeping the peace.
