Re: URGENT: FON CHAFFAH’S SON SHOT...FIVE WOUNDED AFTER CLASH AT BANGOLAN PALACE*

Solomon,
The following paragraph "They also want his head for reportedly setting on fire some artifacts, antiquities amongst others, which they said were the symbol of Bangolan tradition" is significant in that the palace, artifacts and antiquities form part of a protected international and national heritage. The Fon as a Magistrate and a man of law should have known that setting these artifacs and antiquities on fire is a crime punishable in law. In some context, it could constitute an international crime.
At the ICC Ahmad Al Faqi Mahdi, who was an active personality in the context of the occupation of Timbuktu was a member of Ansar Eddine. The Prosecutor alleges that in that capacity, he worked closely with the leaders of two armed groups and in the context of the structures and institutions established by them. The Prosecutor alleges further that, until September 2012, he was at the head of the "Hisbah" (body set up to uphold public morals and prevent vice), operational from May 2012. He was also associated with the work of the Islamic Court of Timbuktu and has participated in executing its decisions. Specifically, it is alleged that he was involved in the destruction of the buildings mentioned in the charges.

In its confirmation of charges decision The Pretrial Chamber "found that the evidence presented by the Prosecutor establish reasonable grounds to believe that Mr Al Faqi is criminally responsible for having committed, individually and jointly with others, facilitated or otherwise contributed to the commission of war crimes alleged by the Prosecutor regarding intentionally directing attacks against the following buildings: 1) the mausoleum Sidi Mahmoud Ben Omar Mohamed Aquit, 2) the mausoleum Sheikh Mohamed Mahmoud Al Arawani, 3) the mausoleum Sheikh Sidi Mokhtar Ben Sidi Muhammad Ben Sheikh Alkabir, 4) the mausoleum Alpha Moya, 5) the mausoleum Sheikh Sidi Ahmed Ben Amar Arragadi, 6) the mausoleum Sheikh Muhammad El Micky, 7) the mausoleum Cheick Abdoul Kassim Attouaty, 8) the mausoleum Ahamed Fulane, 9) the mausoleum Bahaber Babadié, and 10) Sidi Yahia mosque". The artifacts and antiquities of Timbuktu like those found in many of our palaces are protected national and international heritage. The artifacts and antiquities of the Bangolan Palace were not the property of the Fon nor even that of the Bangolan people per se. They were custodians of those international protected artifacts and antiquities. They belong to human civilisation, the creative genuis of humanity. The Fon in the Solomon's posting purports to be defending the palace and even his stool which emanates from a civilization he set out to destroy conflating the public expression of religious beliefs with the destruction of an internationally protected cultural values.
A responsible government, would have set up a judicial commission of enquiry to investigate the destruction of these artifacts and antiquities and the ability or capacity of the Fon to continue to exercise his duty as the custodian of the cultures he destroyed. The commission of enquiry would also hear evidence about the enduring effect of the actions of the Fon and his subjects on the Bangolan throne and sought appropriate means of resolving the outstanding issues according to the cultures and traditions of the people.
Where a Fon and a supposed government rely on the use of force to impose a solution to a problem of this magitude, they sow the seed of strife and instability in the society.
Chief Charles A. Taku
