There are set rules how to terminate an employee, e.g.,
- Normally, appointment t orders inveriably includes a clause regarding the notice period.
- In case of ad-hoc/temporary/contractual employee, notice period varies from 15 days to one calendar month. The employee can be terminated and stands relieved with immediate effect but in such a case, the employer has to pay the salary in lieu of the notice period.
- For confirmed/regularized (normally temporary employee having 5 years of continuous service is deemed to be regularized one) notice period is normally of three months.
- In case of confirmed/regularized Head of Institute (Principal/Director) the notice period is normally of 6 months.
- The above norms applicable to employer are also equally applicable on the part of employee, if s/he wants to quit the job.
- Terminating an employee showing satisfactory performance on the job is in fact a herculean task. There is a set legal process if employer wants to terminate an employee even on account of poor performance. Tribunals, Labor court , etc., protect the interests of employee.

Mr. Kumar K's board discussion is good.
In this article ,one thing is missing and there is no clarity in corporate and any of the service world.
Notice period is 30-90 days varied from organization to organizations.
Whenever employee wants to move out of company he needs to give a notice period of 90 days. Perception is that he is eligible for the salary of three months !!! But (If employer wants to relieve him in next five days, he will get only 5 days salary. Employer has a privilege to relieve employee in 0-30-90 day as he may felt ) vice a versa, if employee wants to move out in five days, he has to shed out 25-85 days salary from his pocket to move out.
Aren't these indiscriminate HR rules !!!

Two decades back when working in Entertainment Sector in Music Industry....the CEO of the music company I was employed with ( a noted lyricist himself ) was very much confident that audio cassettes can never die....people in villages re-record on same tape a dozen times. This was the time when Television ( MTv and Vh1 ) channels were gaining popularity as music channels and the switch was from audio program's to video programs. We were all skeptical as Blue-Ray, LD's and other gizmos were already making inroads in the Indian market. However Internet proved to be a game changer. Within just a few years it not just sounded the death knoll of all music manufacturers but also resulted in closure of music shops - big and small. The suburban station in Mumbai which used to be dotted with music shacks on both sides of the road have now made way for mobile accessories..... with the death of music...many of my friends and colleagues were in a predicament as music sales was the only job they knew. But since life is a struggle...they branched off to other product sales. Luckily for me I skipped the music bandwagon even before its dooms day and had a couple of years experience in Placement which kept me in the Academic field.When the going is good....nobody sits down to plan an alternative...but when the storm of uncertainty crashes...it brings with it waves after tsunami waves of sufferings..... one of my colleague was jobless for almost a year and a half...trying out content writing....pharma selling.. odd jobs to support his family...his wife was in academics - so he was able to manage and stabilize himself but he held firmly to the belief that God would not let him suffer injustice for long.....times would change... his grit and determination and his faith were a reminder that unexpected changes in life try to destabilize us...a trial...a test....how strong you are is what decides your future.But I hope and pray that such tests do not come in lives of any.

Such a job looser has to observe the the followings:
- Be positive, do not lose the courage. Do not get depressed and never think of suicide. If I have no right to take my birth, so also I have no right to take my life. You are the supporter to the life of your near ones, think of their plight and accumulate courage to face the calamity boldly along with them, they are with you only, you are not alone indeed.
- If you are really in need of a job, contact your boss/employer or some one else ASAP, request for reinstatement/a suitable job and assure that you will certainly add value to the organization, forgive any prior mistake and commit not to repeat it.
- Job loss means rise of financial problems. Have the habit of saving 10% of your salary every month.
- Invest bonus,savings, etc., in PPF, KVP, insurance, FD, real estate (at least one house) or mutual funds that can be used for emergency.
- Purchase a few grams gold pa.
- Do not spend on luxuries but only on necessary needs. Be a miser!
- In case of any sever financial issue, approach your near friends and relatives. Some one surely will come to your help.
- The World is wide and open, some one some day is going to get you accommodated.
- We do not have job loss fund provision. Please see the attachment No. 4 and others too.
